Texas has implemented a new law that holds drunk drivers accountable for child support if they cause the death of a parent.

The law, signed by Governor Greg Abbott in June and effective as of last Friday, aims to address the tragic consequences of drunk driving.

Governor Abbott expressed his support for the measure, stating, "Any time a parent passes is tragic, but a death at the hands of a drunk driver is especially heinous. I was proud to sign HB 393 into law this year to require offenders to pay child support for the children of their victims."

Under the new law, individuals convicted of intoxication manslaughter resulting in the death of a child's parent or guardian will be required to make monthly child support payments. The court will consider various factors when determining the amount of these payments. Payments will continue until the child reaches the age of 18 or graduates from high school, whichever occurs later.

In cases where the guilty party is unable to make payments while incarcerated, they will be required to begin making payments no later than one year after their release.

The law also allows the defendant to enter into a payment plan to address any outstanding payments at the time of their release. Regardless of whether the restitution payments were scheduled to end during the defendant's time in confinement, all arrearages must be paid.

This new law serves as a commonsense measure to ensure that those responsible for the death of a parent due to drunk driving are held accountable for supporting the children left behind. By requiring child support payments, Texas aims to provide financial stability and support for these children, helping them navigate the challenges of life without a parent.
