The DOJ argues that creating such a location in Trump's residence, which also serves as a social club, would be an unnecessary and unjustified accommodation. The Biden administration accuses Trump of seeking special treatment and asserts that no other criminal defendant would receive such privileges.
The request for a secure facility at Mar-a-Lago was made by Trump's legal team to avoid the need for mobilizing security every time classified information is discussed. Currently, discussions are taking place at a sensitive compartmented information facility (SCIF).
Although Trump's team did not explicitly state that they wanted to use Mar-a-Lago for these discussions, the DOJ speculates that this is the case based on the request to re-establish the same secure area that existed during Trump's presidency.
Trump's legal team argues that using Mar-a-Lago would allow him to discuss classified information with his counsel without the constant involvement of his security detail and local law enforcement.
Additionally, Walt Nauta, Trump's co-defendant who is charged with obstruction of justice and making false statements, also requested access to all classified discovery in the case. The DOJ acknowledges this request but emphasizes that the resolution of the charges against Nauta does not depend on the classification of the documents he allegedly helped Trump conceal.
In June, Trump pleaded not guilty to all 37 federal charges brought against him by the Biden administration. These charges accuse him of mishandling classified documents. The DOJ maintains that the classified discovery in the case extends beyond the charged documents and includes highly sensitive information that Nauta would not have been permitted to view even with a security clearance.
The Department of Justice's opposition to Trump's request reflects their position that he should not receive special treatment in the handling of classified information.
