Senator Marsha Blackburn (R-TN) has filed a federal lawsuit against Special Counsel Jack Smith, accusing him of unlawfully obtaining her phone records as part of his sweeping investigation into President Donald Trump and conservative lawmakers.
According to The Gateway Pundit, Blackburn is suing Smith in his personal capacity, asserting that he was never lawfully vested with the authority he exercised in the so?called Arctic Frost probe. As reported by The Gateway Pundit, a report from House Judiciary Chairman Jim Jordan details how Smith allegedly coordinated with President Bidens Department of Justice to monitor political opponents, including by secretly subpoenaing phone data from 44 Republican members of Congress.
Those subpoenas, Republicans say, were paired with gag orders designed to ensure that targeted GOP lawmakers would not learn that the Biden DOJ had quietly seized their records. Fox News reports that the lawsuit, titled Senator Marsha Blackburn v. John L. Smith, argues the prosecutor lacked lawful authority to serve as special counsel and violated the lawmakers rights by obtaining the records.
Blackburn is asking the court to declare Smiths appointment unconstitutional, order the destruction of any records obtained from her, and award nominal damages of just one dollar. Per Fox News: The case therefore seeks to test not only Smiths tactics, but the legitimacy of the authority he claims to have exercised as special counsel appointed by then-Attorney General Merrick Garland during the Biden administration.
This lawsuit is solely about holding Mr. Smith accountable and ensuring that our nations justice system can never again be weaponized against the American people, Blackburn told Fox News Digital, framing the case as a broader stand against partisan lawfare. Through his Arctic Frost witch-hunt that targeted conservatives across America and even the president of the United States, Jack Smith perpetrated one of the worst abuses of government power in our nations history, she said.
The legal challenge comes as Smith faces intensifying scrutiny on Capitol Hill, where he testified Tuesday before the Senate Judiciary Committee about his criminal prosecution of President Trump. During that hearing, Senator Ted Cruz (R-TX) condemned Smiths conduct as the most egregious abuse of power in the history of the Department of Justice, underscoring growing conservative demands to rein in what they view as a politicized and unaccountable prosecutorial machine.
