Clinton-Appointed Judge Just Crushed Hannah Dugans Above The Law Defense

Former Milwaukee County Circuit Judge Hannah Dugan has suffered another legal defeat after a federal judge refused to overturn her felony conviction for helping an illegal alien evade federal immigration authorities.

According to RedState, Dugan was accused of assisting Mexican national Eduardo Flores-Ruiz, who was facing state domestic violence charges, in slipping out a side door of the Milwaukee County Courthouse in April 2025 to avoid Immigration and Customs Enforcement (ICE) agents. The incident, captured on courthouse security cameras, quickly went viral and sparked outrage as Dugan claimed she was immune from prosecution because of her judicial office.

That claim collapsed in December 2025 when a federal jury found her guilty of felony obstruction, a verdict that followed her temporary suspension by the Wisconsin Supreme Court in April 2025 and preceded her retirement in January 2026. Her legal fortunes worsened this week when U.S. District Judge Lynn Adelman issued a 39-page order on April 6 denying her post-trial motion to vacate the conviction and rejecting her sweeping immunity arguments.

"After surveying the caselaw, I concluded that there is no general rule of criminal immunity for judges, nor was there a basis for granting immunity simply because some of the allegations in the indictment described conduct that could be considered 'part of a judges job,'" Adelman wrote. His ruling undercut the notionpopular in some activist legal circlesthat a judges robe can serve as a shield against criminal accountability when they step outside the law.

Conservatives seized on the decision as a rare moment of accountability for a member of the judiciary who, in their view, put ideology above public safety and the rule of law. One viral reaction captured the sentiment on the right: "?? BREAKING: A court has officially THROWN OUT disgraced leftist Judge Hannah Dugan's appeal of her felony conviction where she tried to help an illegal alien escape DHS agents to avoid deportation GOOD! LOCK UP the traitor ?? She helped an illegal SCURRY out the back door, but"

The facts of the case left little room for spin. "She helped an illegal SCURRY out the back door, but security cameras captured the whole thing. There's no running from this one."

Dugans legal team had staked her defense on the claim that she was effectively above criminal prosecution for actions taken in her courtroom. "Dugan filed the motion to dismiss, arguing that she had 'absolute judicial immunity' and that the prosecution violated the Constitution's separation of powers by 'intruding on the authority of state judges to manage their own courtrooms and proceedings.'"

Judge Adelman was unpersuaded, reiterating in his Monday ruling that there is no "general rule of criminal immunity for judges" and emphasizing that Dugans conduct fell outside the scope of her legitimate judicial duties. By allegedly orchestrating an escape route for Flores-Ruiz to dodge federal agents, she was not managing proceedings but, in effect, undermining federal law enforcement.

Democrats and their media allies reacted with predictable fury to the prosecution, even as they continue to lecture the country that no one is above the law. The double standard was not lost on conservatives, who noted that the lefts commitment to that slogan seems to evaporate whenever one of their own is in the dock.

The case also became a rallying point for those demanding equal application of the law regardless of political affiliation or immigration status. "A court just rejected Activist Judge Hannah Dugans appeal. Her felony conviction for helping an illegal alien dodge DHS agents and skip deportation has been officially upheld. Lock her up! No one is above the law."

Although Mondays decision addressed a post-trial motion rather than a full appellate review by a higher court, Dugans attorneys quickly signaled they will keep fighting. "We continue to maintain that Hannah Dugan acted lawfully and within her independent authority as a judge," the statement said. "The inconsistent jury verdicts demonstrate that the trial proceedings were flawed, and we plan to appeal."

Adelman, notably, is a Clinton appointee, which makes his refusal to indulge a broad theory of judicial immunity all the more striking in the current partisan climate. After a long string of controversial rulings from Democrat-appointed judges that appeared to favor progressive causes and illegal immigration, many on the right see this decision as a rare instance of the law being applied as written rather than bent to fit an activist agenda.
