As reported by Gateway Pundit, Biden's lackluster performance at the debate may provide some insight into his decision to invoke executive privilege to prevent the release of audio recordings from his October 2023 interview with Special Counsel Robert Hur. The interview was part of an investigation into classified documents, and according to a transcript released by Hur, Biden had difficulty recalling key details such as his tenure as vice president and the passing of his son Beau. Hur decided not to charge Biden for illegally possessing classified documents, stating that a jury would likely view Biden as a "well-meaning, elderly man with a poor memory," which could be interpreted as a diplomatic way of suggesting that the President was mentally unfit to stand trial.
