In a shocking incident, an 18-year-old Idaho man and his mother have been apprehended by the police on allegations of the young man sexually assaulting a 15-year-old girl.
The mother is accused of transporting the minor across state borders to facilitate an abortion, all without the knowledge or consent of the girl's parents.
The accused, Kadyn Leo Swainston, and his mother, Rachael Swainston, both residents of Pocatello, Idaho, are facing multiple felony charges. The charges were filed following an investigation initiated in June when the victim's mother reported her daughter's rape to the police, as reported by the Idaho State Journal.
Kadyn has been charged with rape, second-degree kidnapping, and three counts of producing child sexually exploitative material. His mother, Rachael, is facing charges of second-degree kidnapping, trafficking in methamphetamine, harboring a wanted felon, and two counts of possession of a controlled substance, specifically fentanyl and psychedelic mushrooms.
The investigation began on June 18 when the victim's mother informed the Pocatello police that her daughter had been sexually assaulted and taken to Bend, Oregon, for an abortion without her consent.
On August 7, the victim participated in a forensic interview at a local child advocacy center. She revealed that she had a consensual sexual relationship with Kadyn when he was 17, which continued after he turned 18. The legal age of consent in Idaho is 18.
The victim informed investigators that shortly after Kadyn turned 18, she discovered she was pregnant. She expressed happiness about the pregnancy, but Kadyn was not pleased and insisted she terminate it. The victim provided the police with the medical paperwork she received after the abortion.
Search warrants executed on Kadyn and Rachael's phones revealed they had traveled to Bend on May 18. The victim also allowed the police to extract data from her phone, leading to the discovery of a video and three photos depicting Kadyn and the victim in sexual acts. Kadyn was identified in the photos and video by his tattoos.
On Thursday, the police executed a search warrant on the Swainston's residence. Kadyn admitted during an interview with the police that he had engaged in sexual acts with the victim after he turned 18, knowing she was 15. He also confessed that he and his mother had taken the girl to Oregon for an abortion.
During the search, the police found over 40 grams of meth in Rachael's room and arrested Rick A Parsons Jr, who had been living in Rachael's storage shed and was wanted on an outstanding felony warrant for meth trafficking charges.
Both mother and son were released on their own recognizance after separate arraignment hearings on Friday. They are scheduled to appear in court on November 7 for preliminary hearings. If convicted, Rachael could face life imprisonment for meth trafficking and up to 44 years for the other charges. Kadyn could face life imprisonment for the rape charge, with the other four charges potentially adding up to 115 years.
