J6 Legal Fund, an organization led by a defendant from the January 6th incident, is working with a prestigious polling and market research firm to gather data for a Change of Venue motion.
The organization aims to secure conservative attorneys for political prisoners and believes that obtaining bulletproof data will help address the perceived unfairness in the current forum.
According to statistics, the United States Attorney's Office has a 60 percent overall conviction rate in non-January 6th jury trials. However, in January 6th jury trials, the office has achieved a 100 percent conviction rate. This stark contrast has raised concerns among defendants and their legal teams, leading them to argue for a change of venue.
Former President Donald Trump and his legal team have been vocal about their desire to move his criminal case out of Washington, D.C. They argue that the city's left-wing political leanings would deprive Trump of an impartial jury. Additionally, they claim that the emotional response evoked by the January 6th protest is unique to the region.
Federal District Court Judge Chutkan, who is presiding over several cases related to the Capitol riot, has consistently rejected requests to relocate the trials. In September 2022, she emphasized the importance of jurors being able to set aside their opinions and focus solely on the evidence presented in court.
To support their arguments about jury bias, J6 Legal has enlisted the help of Triton Polling, a firm headed by Sean Bartley. The firm plans to survey hundreds of Washington, D.C. residents to gauge their true feelings about Trump and the events of January 6th. This survey will be conducted in a novel way, aiming to provide statistical evidence of jury bias.
Attorney Steve Metcalf, representing J6 defendant Jake Lang, expressed concerns about jurors being "recycled" in January 6th trials. He claimed that this is an unprecedented occurrence and raises questions about the fairness of the jury selection process. Metcalf believes that the survey conducted by Triton Polling will shed light on these issues.
The survey will address various aspects, including the jurors' knowledge of the January 6th protest, their views on the protestors' actions, and their opinions about Trump's responsibility for the events. The questions have been carefully designed to uncover the inherent bias that Washington, D.C. residents may have against Trump and the January 6th protestors.
Lang, the J6 defendant leading the organization, emphasized the importance of this survey in ensuring a fair trial. He believes that the current bias against Trump and the protestors poses a constitutional crisis and that changing the venue of the trials is the only solution.
