Federal prosecutors under Jack Smith quietly swept up draft fundraising emails and personal data from hundreds of President Trumps supporters in the wake of the 2020 election, casting a long shadow over political privacy and constitutional rights.
According to the New York Post, internal records reveal that Smiths office obtained draft appeals for the Trump Make America Great Again Committee (TMAGAC), including messages in which Sen. Ted Cruz (R-Texas) urged his backers to become 2020 Election Day Donors. These materials were gathered under the FBIs Arctic Frost investigation into President Trumps post-election challenges, a probe that federal authorities linked to the events of Jan. 6, 2021, at the US Capitol.
Cruz, one of the few Republican senators who declined to certify the 2020 electoral count for Democrat Joe Biden, said Smiths team vacuumed up the personal information of as many as 336 Texans whose only offense was civic engagement. He told the Post that these individuals were targeted merely for exercising their constitutional right to participate in the political process.
Arctic Frost represents the most egregious abuse of power in the history of the Department of Justice, Cruz said. We still do not know the full extent of these and related violations, but we do know that there has been vastly insufficient accountability for the violations we do know about.
Early in the inquiry, federal investigators sought to obtain call logs and metadata from Cruzs cell phone through AT&T, but the telecommunications giant refused to comply. Another carrier, Verizon, did turn over records for other lawmakers, and a subpoena for the phones toll analysis was shielded from public view by a non-disclosure order signed by a federal judge.
Cruz has argued that Smiths aggressive tactics in Arctic Frost will be remembered as Joe Bidens Watergate, framing the probe as a politically driven scandal rather than a neutral investigation. His criticism underscores a broader conservative concern that federal law enforcement has been weaponized against President Trump, his allies, and ordinary Republican voters.
Sen. Chuck Grassley (R-Iowa), who leads the Senate Judiciary Committee, obtained the latest tranche of records through protected whistleblower disclosures. My colleague, Senator Cruz, was right to remind Americans of President Trumps work to strengthen our economy, stop socialism and stand up to Iran, Grassley said.
Republicans remain united in our support for Americas national security and economic freedom, he added. Despite Jack Smiths attempt to throw him in prison, President Trump is still fighting for these America First principles today.
Subpoena returns released by Grassleys committee this month indicate that up to 639,000 Republican donors, voters and supporters had their information captured by Smiths office. Those affected ranged from Americans who contributed as little as $1 to President Trumps 2020 re-election effort to customers who simply bought red Make America Great Again hats from vendors routing proceeds to the campaign.
Grassley has repeatedly described Smiths operation as a sweeping fishing expedition that reached far beyond President Trump and a small circle of advisers. In his view, the scope of Arctic Frost suggests an attempt to scrutinize and intimidate the broader Republican Party infrastructure at the very moment President Trumps second administration is working to restore trust in federal institutions and reassert constitutional limits on government power.
