Ilhan Omar (D-MN) is facing mounting scrutiny after a federal magistrate judges role in authorizing the raid on her Washington, DC, home undercut her claims that the operation was nothing more than political retribution by a vengeful President Trump.
According to The Gateway Pundit, Omar has loudly portrayed last weeks pre-dawn search of her residence as partisan persecution, insisting she is innocent of any wrongdoing. Yet new reporting from CNN shows that Justice Department prosecutors were first required to navigate a prolonged back-and-forth with Judge Matthew Sharbaugh, a federal magistrate judge on the DC District Court, before any warrant could be executed.
Prosecutors, however, first had to contend with a federal magistrate judge, in a prolonged back-and-forth that hasnt previously been reported, CNN disclosed, underscoring that the process was anything but a rubber stamp. Judge Matthew Sharbaugh of the DC District Court ultimately limited how the Justice Department could access Omars documents in Mondays search, before he would approve the warrant, because of her role as a member of Congress and the Constitutional protections that affords, multiple people familiar with the investigation told CNN.
Those constraints directly contradict Omars narrative of an unchecked, politically motivated assault on her rights, revealing instead a judiciary taking special care to respect constitutional safeguards for a sitting lawmaker. The revelation also confirms what conservative legal expert Mike Davis, founder of the Article III Project and former Senate Judiciary Committee counsel, had already suspected.
As previously reported by The Gateway Pundit, Davis believed Sharbaugh was the magistrate who signed off on the search of Omars home, based on public records from the DC U.S. District Court. He pointed out that the courts website showed Sharbaugh was the magistrate on criminal duty from October 3 through October 16, 2026, the period covering the raid, though he acknowledged there was a slim chance Sharbaugh might have been unavailable during that window.
The fact that Sharbaugh ultimately approved the warrant is particularly striking in light of his political and professional background, which leans decidedly to the left. Davis, writing in a Fox News op-ed, highlighted that Sharbaugh had financially backed Hillary Clintons failed 2016 presidential campaign against Donald Trump.
From Davis: Before becoming a judge, Sharbaugh donated to Hillary Clinton during her losing 2016 campaign against President Trump. Sharbaugh clerked twice for Judge Robert Wilkins, a leftist appointee of President Obama, on both the D.C. U.S. District Court and the D.C. U.S. Circuit.
Davis further noted that Judge Wilkins was one of the three D.C. U.S. circuit judges rammed through by former Democrat Senate Majority Leader Harry Reid at the end of 2013, just before Republicans took control of the U.S. Senate. Sharbaughs rsum, in other words, is hardly that of a Trump loyalist eager to do the presidents bidding.
Sharbaugh also has a record of rulings that have not favored the Trump administration or its priorities, reinforcing the implausibility of Omars claim that the raid was orchestrated by MAGA-aligned forces. In one notable case from August, Sharbaugh RELEASED a woman accused of deliberately defacing the World War II Memorial, allowing her to walk free on a personal recognizance bond despite the Justice Departments objections.
This came despite the DOJs pleadings, coverage noted, underscoring his willingness to side against federal prosecutors even when they sought tougher measures. For conservatives, this history makes it all the more clear that Omars attempt to blame Trump is a political smokescreen rather than a serious legal argument.
The Gateway Pundit previously reported that federal agents raided Omars DC-area residence early Monday morning as part of an ongoing criminal fraud investigation into her immigration paperwork. The probe reportedly centers on documents completed by her late father when she was a child, raising questions about the integrity of the process that ultimately led to her citizenship.
The pre-dawn raid was part of an ongoing criminal fraud investigation into the Somali-born congresswomans immigration paperwork, documents filled out by her late father when she was a child, the outlet reported. According to Omars own website, she arrived in the United States in March 1995 at age 12 as a Somali refugee after roughly four years in a Kenyan refugee camp, and she became a naturalized U.S. citizen in 2000 at age 17.
Multiple agents wearing HSI (Homeland Security Investigations) jackets were seen outside the residence around 6 a.m., a visible sign that this is a serious federal inquiry, not a campaign-season stunt.
For a lawmaker who has long cast herself as a victim of American institutions she routinely denounces as racist and oppressive, the involvement of a left-leaning judge with a history of opposing Trump-world interests undercuts her latest claims of persecution. As the investigation into her immigration history unfolds, Omars political spin is colliding with a legal process that, by all available evidence, has been anything but friendly to the president she is trying to blame.
