Dr. Anthony Fauci has refused a request to appear voluntarily before a second Senate panel, intensifying a high-stakes clash with Republican lawmakers over his handling of the COVID-19 pandemic and his conduct under oath.
According to Breitbart, Fauci rejected an invitation to testify before a Senate Homeland Security subcommittee after majority Republicans on the full committee voted along party lines to hold the longtime infectious disease official in contempt. The contempt vote, taken on August 6, followed a combative July 29 hearing and is expected to be referred to the Department of Justice for potential investigation.
In a sharply worded letter to Sen. Ron Johnson of Wisconsin, a lawyer for the former director of the National Institute of Allergy and Infectious Diseases argued that any attempt to compel further testimony would be an abuse of congressional power. The attorney wrote that such an effort would serve only to impermissibly harass or degrade Dr. Fauci for political purposes.
During the July hearing focused on his management of the pandemic, Fauci invoked his Fifth Amendment right against self-incrimination 100 times, a move that infuriated Republicans seeking accountability for lockdowns, mandates, and disputed public-health guidance. That aggressive use of constitutional protections became the central justification for the contempt vote, as GOP senators questioned whether Fauci was shielding himself from scrutiny over his past statements and decisions.
Republican Sen. Rand Paul of Kentucky, the committee chairman who led the push for contempt, argued that Faucis Fifth Amendment claim was invalid because President Joe Biden had already granted him a preemptive pardon. Paul maintained that under those circumstances, Fauci did not need to be concerned about potential prosecution.
Paul, a longtime critic, has repeatedly accused Fauci of misleading the public and Congress, and has repeatedly called for Fauci to be prosecuted and imprisoned. Johnson, who chairs the subcommittee on investigations, has sought a parallel probe into Faucis role in the COVID-19 response, including the safety and efficacy of the vaccinesissues that many conservatives believe were shielded from honest debate by an entrenched public-health bureaucracy.
