The preliminary hearing in the attempted assassination case involving conservative activist Charlie Kirk is rapidly turning into a cautionary tale about judicial drift and courtroom chaos, according to one prominent legal analyst.
Criminal defense attorney and Fox News legal contributor Donna Rotunno, best known for her high-profile but unsuccessful defense of Harvey Weinstein, warned that the judge overseeing the case may be allowing the process to spiral out of control. According to Mediaite, Rotunno argued that Judge Tony Graf can stop all this and say, Ive heard enough evidence, there is enough to move this case on to trial, and we dont need to continue along this path, because Ive heard what I need to hear at this juncture.
Rotunno, speaking from the perspective of a seasoned trial lawyer, suggested that Grafs reluctance to impose firm limits on the proceedings risks turning the hearing into a spectacle rather than a sober search for truth. She added, He does run the risk of becoming Judge [Lance] Ito. What we are watching here is that he is not taking control. Hes not taking control of the timing, of the scheduling, of the deadlines. Remember, they have been litigating these issues for weeks now, and the fact that on 11th hour in middle of this hearing, the defense files these objections that should have been dealt with weeks before this Josh [Ritter] and I have been talking, [and] we dont understand how yesterday, the defense is now allowed to go into the most significant piece of evidence we have all known is coming.
Her criticism underscores a broader concern on the right that high-profile cases involving conservative figures are too often allowed to devolve into media circuses and procedural gamesmanship. We may not have known what was in it, but we knew that it was happening, Rotunno said of evidence presented in the courtroom today, adding, The fact now that in the middle of this, we have raised other evidentiary issues that have already had the opportunity to be dealt with, but the higher court already ruled on the fact this is preliminary hearing, heres these things coming in, and the fact they keep relitigating the issue, and the judge is letting them do that is creating this appearance for the world that this is not judicial, it is not expedient, and everybody is wondering when were just going to move on to the next phase of this proceeding.
On Thursday, Utah prosecutors played audio recordings of police interviews with Luna Twiggs, the former roommate and one-time romantic partner of alleged shooter Tyler Robinson. Defense attorneys tried to block the clips, arguing that prosecutors were effectively treating Twiggs statements as a confession by Robinson, who turned himself in one day after Kirk was shot and has yet to enter a plea.
The hearing has now stretched into a fourth day, raising questions about whether the process is being allowed to drag on at the expense of clarity and justice. As President Trumps second administration continues to emphasize law and order and equal treatment under the law, some of Kirks supporters worry that the memeification of the conservative commentator could distract from the gravity of the charges and the need for a disciplined, efficient judicial process.
