According to Western Journal, the move centers on the 2009 endangerment finding, a determination that six greenhouse gasses posed a threat to public health and welfare and therefore justified expansive federal intervention. As reported by The Wall Street Journal, that foundational finding is now slated to be overturned, effectively dismantling the legal basis for a host of climate rules imposed over the past decade and a half.
The endangerment finding granted the Environmental Protection Agency authority to regulate emissions from power plants and vehicles, a power that was used aggressively under President Barack Obama to reshape the nations energy sector. By targeting that legal cornerstone, the Trump administration is not merely tweaking policy at the margins but challenging the regulatory states claim to control vast swaths of the American economy in the name of climate change.
This amounts to the largest act of deregulation in the history of the United States, EPA Administrator Lee Zeldin said, underscoring the scale of the coming shift. The final rule, which is expected to be released this week, would mark one of the most consequential victories yet for those who argue that unelected bureaucrats have overreached in dictating energy and environmental policy.
The Journal reported that the rule removes the regulatory requirements to measure, report, certify and comply with federal greenhouse-gas emission standards for motor vehicles, and repeals associated compliance programs, credit provisions and reporting obligations for industries, citing unnamed administration officials. While the new rule does not immediately rescind existing regulations on power plant emissions, it is widely viewed as a crucial first step toward loosening those restrictions as well.
President Trump set this process in motion on his first day in office by directing the EPA to reexamine whether the endangerment finding should stand.
