Alina Habba, the U.S. Attorney for the District of New Jersey, has announced her resignation, citing a ruling by the Third Circuit and her commitment to maintaining the "stability and integrity" of her office.
According to The Post Millennial, Habba's announcement came on Monday, following a tenure marked by significant reductions in crime rates and successful prosecutions under the guidance of Attorney General Pam Bondi and Deputy Attorney General Todd Blanche.
Habba's office was instrumental in achieving Camden's first murder-free summer in half a century, a testament to their relentless efforts to rid the streets of violent offenders.
However, Habba's position came under scrutiny last week when a federal appeals court ruled that her appointment by the Trump administration was unlawful. The three-judge panel of the 3rd U.S. Circuit of Appeals upheld a lower court's decision, stating, "Under the Governments delegation theory, Habba may avoid the gauntlet of presidential appointment and Senate confirmation and serve as the de facto U.S. Attorney indefinitely. This view is so broad that it bypasses the constitutional (appointment and Senate confirmation) process entirely."
In her full statement, Habba reflected on her five-year tenure, stating, "For the past five years, Ive fought for justice on behalf of the American people, and in my tenure under our great Attorney General Pam Bondi and Deputy Attorney General Todd Blanche, we made New Jersey safer. Camden had its first murder-free summer in 50 years. We drove down crime, took violent offenders off the streets, caught terrorists, and put away child predators."
She also expressed her disappointment with the politicization of the justice system, accusing judges in her state of exploiting a flawed blue slip tradition and becoming "weapons for the politicized left." Habba argued that these judges, along with New Jersey senators more focused on opposing President Trump than serving their constituents, obstructed justice by halting trials and sentencing, leaving violent criminals on the streets.
Despite the Third Circuit's ruling, Habba remains undeterred, stating, "This decision will not weaken the Justice Department and it will not weaken me." She plans to continue her fight for justice in her new role as the Senior Advisor to the Attorney General for U.S. Attorneys.
U.S. Attorney General Pam Bondi expressed her regret over Habba's resignation, stating, "Following the flawed Third Circuit decision disqualifying Alina Habba from performing her duties in the U.S. Attorneys Office for the District of New Jersey, I am saddened to accept Alinas resignation." Bondi criticized the politicized judges for undermining Habba's ability to effectively run her office and countermanding the President's choice of attorneys.
Bondi also praised Habba's achievements, highlighting a 20% reduction in crime in Newark and Camden's first homicide-free summer in 50 years under her leadership. She expressed confidence that the Department of Justice will seek further review of the decision and that it will be reversed, allowing Habba to return to her role as U.S. Attorney for the District of New Jersey.
As Habba transitions to her new role as Senior Advisor to the Attorney General for U.S. Attorneys, she remains committed to her fight against violent crime, proving that while she may no longer be the U.S. Attorney for New Jersey, her dedication to justice remains unwavering.
