In a recent legal development, a magistrate judge has denied the Department of Justice's (DOJ) request to detain Jacob Samuel Winkler, a man accused of attempting to disrupt Marine One's flight with a red laser pointer.

As reported by Gateway Pundit, the DOJ charged Winkler on Monday following the Saturday incident. The legal complaint details how Winkler allegedly directed a red laser at Marine One, temporarily disorienting Officer Santiago, who was on duty at the time. "The red laser beam hit Officer Santiagos eyes and briefly disoriented him," the complaint states.
The helicopter was flying at a low altitude, making the situation particularly perilous. Officer Santiago's training led him to recognize the act as a significant threat, as it posed a risk of flash blindness and pilot disorientation, which could have resulted in a catastrophic airborne collision.
Upon being apprehended, Winkler reportedly expressed remorse, stating, "I should apologize to Donald Trump," and "I apologize to Donald Trump." The legal complaint further asserts that Winkler "did knowingly aim the beam of a laser pointer at an aircraft in the special aircraft jurisdiction of the United States, or at the flight path of such an aircraft."
Consequently, Winkler faces charges under 18 U.S. Code 39A, which prohibits such actions.
Despite the gravity of the charges, Magistrate Judge Zia Faruqui opted not to detain Winkler, a decision that has sparked debate. The case has now been assigned to Judge Beryl Howell, an appointee of President Obama.
