S. Magistrate Judge Martin Fitzpatrick as hes been saved by the bell in the dispute between Governor Ron DeSantis of Florida and Walt Disney Parks and Resorts U.S.

According to a report by the New York Post, the judge wrote in a court document that because he is related to an employee in the third degree who works at Disney, he must recuse himself from hearing the case due to a conflict of interest. The case will be reassigned to another judge.

Fox News reports the complaint alleges, This government action was patently retaliatory, patently anti-business, and patently unconstitutional. But the Governor and his allies have made clear they do not care and will not stop.

On Wednesday, the mega-theme park retaliated against DeSantis and the State of Florida by filing a lawsuit in the U.S. District Court for the Northern District of Florida. The lawsuit accuses the Governor of orchestrating a targeted campaign of government retaliation, which would violate the companys right to free speech.

A response by Governor DeSantis office pointing out Disneys special District status was forthcoming.

The legal action by Disney is the result of the Central Florida Tourism Oversight District voting to invalidate two contracts signed in February by Disney. The Governor recently appointed the board to oversee the District where the Disney theme park resides.

In a statement by Taryn Fenske, DeSantis communications director, she stated, We are unaware of any legal right that a company has to operate its own government or maintain special privileges not held by other businesses in the state. This lawsuit is yet another unfortunate example of their hope to undermine the will of the Florida voters and operate outside the bounds of the law.

Governor DeSantis has commented on the lawsuit, saying it has no merit. He also said it is time for the Disney company to live by the same rules as everybody else.
