In a recent discussion on "Jesse Watters Primetime," John Yoo, a legal scholar and former Department of Justice official, proposed that Robert Hur, a former Special Counsel, should lead a potential special committee to investigate former President Joe Biden's mental health.
This suggestion comes in the wake of the release of "Original Sin," a book by CNNs Jake Tapper and Axios Alex Thompson, which explores Biden's alleged mental decline during his presidency.
According to the Daily Caller, the book has sparked calls for an investigation into the alleged cover-up of Biden's health issues. Kayleigh McEnany, the guest host, questioned Yoo about his proposal for Congress to form a special committee for the investigation, and how it would compare to the probe initiated by House Oversight Committee Chair James Comer.
Yoo responded, I think the first thing it does is that it would get people under oath. These people could then not lie, obfuscate, tell the American people things that are not true in order to cover up President Bidens health. Also, I think, to conceal whether they themselves abused power, broke federal laws by exercising the power of the Office of the Presidency without his authorization.
He further suggested that such an investigation typically has a single person, a special counsel, at its helm. He proposed Robert Hur for this role, stating, If those Biden aides, Biden family members refuse to cooperate, then you have the Justice Department [who] can go in and force those subpoenas and throw people in jail for refusing to answer Congresss questions.
Comer, in a recent interview with Fox News host Jesse Watters, revealed that the Oversight Committee had contacted four former Biden staffers and former White House physician Kevin OConnor for questioning. If these individuals refuse to cooperate, the committee would then issue subpoenas.
McEnany further queried Yoo about the appointment of Hur to the potential investigation, considering his unbiased stance due to his previous involvement in a case against the Trump administration. Yoo explained that there are two types of special counsels: one created by Congress and one triggered by the Justice Department. He suggested that Attorney General Pam Bondi could appoint Robert Hur as a special counsel.
Yoo stated, In fact, you could almost say he has unfinished business. We only got a glimpse of it from Robert Hurs first investigation when he said, Joe Biden could not actually be put on criminal trial because hes a well-meaning man who has memory issues.' Robert Hurs already halfway deep into the case. Why not get the guy whos already the expert on this? Pam Bondi just has to ask, and he has to accept, and then they can get started right away.
The book by Tapper and Thompson reveals that Biden's health was a concern for Republicans even before his presidency. It became so severe during his tenure that his aides considered using a wheelchair for him.
In January 2023, former Attorney General Merrick Garland appointed Hur as the special counsel to investigate Biden's mishandling of classified documents. Hur's report, released in February 2024, described Biden as an "elderly man with a poor memory" and declined to pursue criminal charges.
