A lawsuit filed by the Republican Party, seeking to prohibit the counting of mail-in ballots in Nevada received up to four days post-election, has been dismissed by a federal judge.
The lawsuit challenged a state law enacted in 2021, which the GOP alleges enables Democratic organizers to manipulate election results in their favor.
According to Gateway Pundit, the suit was dismissed by Chief Judge Miranda Du of the Federal District Court, who was appointed during the Obama administration. In her 15-page ruling, Judge Du stated that there was no evidence to suggest that the plaintiffs "have suffered, or will likely suffer, an injury" due to the rules in question. These rules, according to the GOP, allow Democrats and allegedly corrupt election officials to "find" the necessary votes to swing elections where Republican candidates hold a slim, yet surmountable, lead.
Judge Du wrote, "It does not necessarily follow that mail ballots arriving after Election Day will skew Democratic." She further added, "And even if later-arriving mail ballots have favored Democrats past elections, it is far from guaranteed that Nevada voters will behave similarly this November."
She continued, "The Nevada mail ballot receipt deadline does not have an 'individual and personal' effect on the voting power of Republican voters; it neither undermines their access to the polls nor disproportionately diminishes the weight of their votes relative to other Nevada voters."
The Gateway Pundit has consistently highlighted that mail-in ballots are just one of the numerous tactics allegedly employed by Democratic organizers to secure victory, often at the expense of legitimately elected conservative candidates. This was evident in the 2022 Senate election, where Republican Adam Laxalt's lead over incumbent Sen. Catherine Cortez-Masto was overturned when ballots were suddenly discovered, providing an 8000 vote margin of victory.
The GOP, undeterred by the dismissal, has vowed to appeal the decision. Spokesperson Claire Zunk told Courthouse News that their fight for election integrity will continue. "Our case fights a Nevada law that shouldn't be on the books; it breaks federal law and allows mail ballots to be counted after Election Day," Zunk stated.
She added, "Rather than letting us fight this in court, a liberal judge unjustifiably dismissed our case. Political parties must be allowed to fight invalid election laws that threaten the integrity of our elections. We are committed to protecting the ballot and we will pursue further legal action in this case."
