Newly released CCTV footage from January 6, 2021, shows Vice President Kamala Harris leaving the U.S. Capitol at 11:21 AM, contradicting the Department of Justice's (DOJ) claims that she was present in the building during the Capitol riot.

The video, released by Free State Will, has raised questions about the accuracy of the DOJ's indictments against Trump supporters involved in the riot.

The footage also reveals a man, dressed as a protester in a hoodie, seemingly coordinating with police before any protesters entered the US Capitol that day. This revelation has further fueled the controversy surrounding the events of January 6.

Over 100 individuals involved in the January 6 incident have been charged with 1512c felony charges. The DOJ's indictment alleges that both Vice President Kamala Harris and then Vice President Mike Pence were in the US Capitol at the time of the rioting. However, the newly released video footage appears to contradict these claims.

A mother of one of the defendants charged with a felony by the DOJ has raised several issues with the government's allegations. She argues that neither Harris nor Pence were at the Capitol during a critical time period. The woman further criticizes the 1512 felony charge, which could potentially result in a jail sentence of up to 20 years. She asserts that this charge is inaccurate as no Congressional Session was being held at the time, and neither Harris nor Pence were present at the Capitol.

The woman's argument is supported by the fact that both Harris and Pence had been evacuated from the Capitol grounds due to the discovery of a pipe bomb at the Democratic National Committee (DNC) and the Republican National Committee (RNC). Harris was at the DNC, and Pence left around 1:40 PM, indicating that neither of them were present during the riot.

The 1512 felony charge was originally leveled against Enron employees who destroyed evidence during hearings in Washington, DC. The application of this charge in the context of the Capitol riot has been questioned by many.

In November 2021, Politico, a left-leaning news outlet, admitted that the accusations against the defendants were not accurate. The publication revealed that Harris was blocks away at the offices of the DNC when the mob overran the Capitol. She was evacuated after authorities discovered a pipe bomb outside. Prosecutors have since removed language related to Harris from hundreds of Capitol riot indictments.

Despite these revelations, hundreds of Trump supporters were indicted by the DOJ, which falsely claimed that Harris was still in the building when the Capitol was first breached. This has led to calls for accountability for the DOJ's actions.

The question of Vice President Pence's whereabouts during the riot has also been a point of contention. The DOJ insists that Pence was still on Capitol property during the breach, but it is known that he was taken to an underground garage. The exact location, however, remains unknown.

Defendants are not permitted to question witnesses, including Secret Service agents, about Pence's precise location to confirm whether he remained on Capitol grounds, which would justify the charges against them.

The charge under review, 1752, is currently being examined by the DC appellate court. During oral arguments, the panel seemed inclined to send one case back to the judge and require the judge to demonstrate foreknowledge of Pence's presence at the Capitol.

This development could potentially lead to a wave of court filings related to the over 1,000 individuals charged with 1752. The implications of these revelations and their impact on the ongoing legal proceedings related to the January 6 riot remain to be seen.
