Over two dozen groups are imploring the Biden administration to forgo any intentions to let biological males participate in women's sports and to use the same locker rooms.
The Education Department of the Biden Administration put forth a proposition in 2022 that broadened the definition of gender bias to include "gender identity" as part of Title IX of the Education Amendments of 1972. This coming spring, the department is going to issue another set of regulations that will concentrate on how Title IX applies to transgender athletes playing on women's sports teams.
On Tuesday, the Defense of Freedom Institute for Policy Studies coordinated a letter to Secretary of Education Miguel Cardona, which was signed by a variety of lawyers, specialists, parents, civil rights organizations, and previous education officials. The letter expressed the opinion that the extra regulations proposed by the Biden administration would be "unjust" in their effect on female athletes.
"The Department does not have the legal authority to issue regulations that would subvert rather than fulfill the requirements of Title IX by permitting or requiring biological males who identify as females to compete in sex-separated womens sports and to use the intimate facilities and shared spaces of female students we anticipate that the coming rulemaking on athletics will similarly conflate gender identity with Title IXs sex-based protections and degrade those very protections."
It is contended that Title IX, which only applies to the forbiddance of gender-based discrimination in any education program or activity that is receiving Federal funding, does not encompass gender identity.
The signatures of many organizations were put to the letter, including the Heritage Foundation, Heritage Action for America, Ethics and Public Policy Center, SAVE, Independent Women's Law Center, Child and Parental Rights Campaign, Texas Eagle Forum, Family Policy Alliance, No Left Turn in Education, Southeastern Legal Foundation, American Civil Rights Project, and Parents Defending Education.
Bob Eitel, president of the Defense of Freedom Institute, insists that "The Departments view that Title IX extends to gender identity is an extremist position not supported by the purpose, text, structure or legislative history of Title IX. More importantly, if the administration proceeds with its radical rewrite of Title IX, it will result in severe harm to biological women and girls and cause them to lose positions on athletic teams, awards, scholarships and prizes, as well as risk bodily harm in certain sports."
At his confirmation hearing, Cardona declared his backing for permitting biologically male transgender individuals to participate in women's sports. He emphasized the need for educators and school systems to respect the rights of all students, including those who are transgender, noting that all students should have the chance to take part in activities.
There has been criticism from female athletes, both current and past, of the Biden administration's decisions, claiming they have put females at a disadvantage when it comes to competing against biological males.
In an interview with Fox News Digital this month, Riley Gaines, an NCAA swimmer, and All-American athlete voiced her disagreement with President Joe Biden's support of "gender ideology propaganda."
In a swimming competition, Gaines was pitted against Lia Thomas, a 6 foot 4 biological male. The two ended up tying for first place, something she believes was not a fair situation due to the physical disparities between them.
Gaines expressed her thoughts prior to Bidens State of the Union address. "I am truthfully intrigued as to how he will address the state of our nation. What is the state of our nation? What's the condition of it?"
