The United States Supreme Court is set to hear arguments on February 8, 2024, regarding former President Donald Trump's appeal against a Colorado Supreme Court ruling that removed him from the presidential ballot.
This case carries significant weight, as its outcome could influence similar ballot access disputes nationwide, potentially shaping the 2024 presidential election.
In a split decision last December, the Colorado Supreme Court invoked the Fourteenth Amendment's "Insurrection Clause" to justify Trump's removal from the 2024 presidential ballot. This ruling partially overturned a lower court's decision, which stated that Trump, not being a current officer of the United States, could not be disqualified from the Colorado primary ballot under the Fourteenth Amendment.
The Colorado Supreme Court, without a formal conviction or charge against Trump for insurrection, concluded there was "clear and convincing evidence" of his involvement in such activities. This decision was made despite the former President's acquittal by the U.S. Senate on charges of insurrection and his continued denial of any wrongdoing.
The court's ruling drew from the U.S. House January 6 Select Committee's findings, even though the Senate had acquitted Trump of the House's charges.
The Colorado case is part of a broader series of lawsuits filed across the country, all leveraging the "Insurrection Clause" to argue for Trump's removal from the ballot. While Trump has seen favorable rulings in several states, including an initial victory in Colorado that was later partially reversed by its Supreme Court, he has also been removed from the ballot in Maine.
The U.S. Supreme Court has yet to provide a definitive interpretation of Section Three of the Fourteenth Amendment. Its ruling on the Colorado case could potentially set a precedent affecting similar cases in Maine and other states.
The case, known as Trump v. Anderson, No. 23-719, is currently before the Supreme Court of the United States.
