A lawyer for five Proud Boys on trial for a seditious conspiracy has decided that he will attempt to call Donald Trump as a witness in the trial.
NBC News reports that it is not clear that Trump will be compelled to testify.
Joe Biggs, a Proud Boys organizer from Florida, is on trial. His lawyer revealed a subpoena Thursday asking Donald Trump to come and testify in this particular trial. The subpoena would also get the Justice Departments assistance to get Donald Trump to testify in this trial. Some are calling the move a long shot, but this is something that the lawyer believes that it is worth the effort.
Biggs lawyer Norm Pattis said: Donald Trump called on patriots to stop the steal, and Were calling on Donald Trump to take the stand.
The Trump campaign did not immediately respond to a request for comment in this situation.
The legal team will have to deal with many logistical hurdles to serving the former president. That is not something that can be done quickly, which is why many people are interested to see if such a tactic is viable. Many assume that this is not going to happen and that it wont work as hoped by the legal team.
U.S. District Judge Timothy Kelly is the judge in the case, but he has not expressed an opinion either way about if the subpoena should be honored at this time.
NBC News reports that this is not the first attempt by a January 6th defendant to call the former President to the stand. Dustin Thompson, an Ohio man charged with crimes related to January 6th, tried to subpoena Donald Trump during his February 2022 trial. In his case, the judge ruled that his testimony of Trump was not relevant enough to the case to force him to be compelled to testify, which was denied. Thompson was convicted on six counts related to the events of January 6th.
Biggs and his co-defendants Enrique Tarrio, Ethan Nordean, Zachary Rehl, and Dominic Pezzola, have been charged with seditious conspiracy, in addition to various other felonies, according to NBC News. They will have to try to fight off all of these different charges with the help of their lawyers if they can do so.
