In a recent court development, Judge Aileen Cannon has denied Special Counsel Jack Smith's request to file documents in the Trump classified documents case under seal.

In a court brief signed on Monday, Cannon stated that Smith's motion to file a "supplement" containing additional information failed to establish a sufficient legal or factual basis for sealing the documents.

Smith had argued that the supplement should be sealed to comply with grand jury secrecy. However, Cannon found that the motion and supplement did not meet the burden of proof required to warrant sealing.

In her brief, Cannon wrote, "The Special Counsel states in conclusory terms that the supplement should be sealed from public view 'to comport with grand jury secrecy,' but the motion for leave and the supplement plainly fail to satisfy the burden of establishing a sufficient legal or factual basis to warrant sealing the motion and supplement."

Furthermore, Cannon requested information from prosecutors regarding the use of an out-of-state grand jury to investigate the case. She specifically asked for the legal propriety of using an out-of-district grand jury proceeding to continue the investigation and seek post-indictment hearings on matters relevant to the indicted matter in this district.
