On a recent broadcast, Cuomo criticized Peter Navarro, a former adviser to President Donald Trump, who was incarcerated for defying a subpoena. This prompted a user on X to challenge Cuomo's apparent bias, questioning, "How can you stand by and not see the complete unfairness of what he faced compared to the other side who literally never even shows up and nothing happens. Do you not ever try to be unbiased?"
Cuomo's retort was swift and dismissive: "Show me who on the left refused to answer a subpoena and got away with it? The answer is no one. Be right or be quiet." However, this assertion seems to overlook several notable instances from recent history.
According to Western Journal, during the Obama administration, several officials ignored subpoenas without facing jail time. Eric Holder, the former Attorney General, notably refused to comply with a 2012 subpoena related to the Fast and Furious gun-walking scandal. Although he was held in contempt of Congress, he did not face imprisonment. Similarly, Lois Lerner, an IRS official implicated in the targeting of conservative groups, was found in contempt of Congress in 2015, yet the U.S. Attorney for the District of Columbia, under the Obama administration, opted not to pursue criminal contempt charges.
Furthermore, the Biden administration has not been immune to such controversies. Hunter Biden, the President's son, notably disregarded a congressional subpoena by choosing to hold a media briefing rather than appear before the House Oversight and Judiciary committees to address allegations of influence-peddling. This incident occurred despite President Biden's earlier assertions in 2021, which now seem at odds with his son's actions.
Cuomo, a seasoned media professional, appears to have overlooked these significant instances where prominent Democrats evaded legal repercussions for ignoring subpoenas. This oversight raises questions about the consistency of legal accountability across the political spectrum. While Cuomo's challenge to "be right or be quiet" may have been intended as a definitive statement, it inadvertently highlights a broader issue of selective enforcement and memory within political discourse.
