The discussion centered on the contentious issue of trans-identified males competing in womens sports.

According to The Post Millennial, McMahon's letter expressed concern over the lack of clarity from Newsom's office regarding the enforcement of federal law in California schools. "Your recent comments about male athletes playing in womens sportsthat it is 'deeply unfair'came to the attention of my office this week," McMahon wrote.

She further requested clarification on Newsom's stance and his intentions to ensure compliance with federal regulations. The Education Secretary underscored that a significant majority of Americans oppose biological men competing in womens sports, yet confusion persists due to the silence from Newsom's office on the broader implications of substituting 'gender identity' for sex in educational settings.

McMahon warned that allowing participation in sex-separated activities based on 'gender identity' could lead to Title IX violations and the potential loss of federal funding for schools. She urged Newsom to fulfill his responsibility by informing California school districts of these risks. The letter concluded with a formal request for Newsom to publicly assure parents that California educators will not support 'gender transitions' for students without parental consent.

During his podcast conversation with Kirk, Newsom acknowledged the "unfairness" of trans-identified males in womens sports but also expressed empathy for the challenges faced by transgender individuals. He remarked, "Theres also a humility and a grace. You know that these poor people are more likely to commit suicide, have anxiety and depression, and the way that people talk down to vulnerable communities is an issue that I have a hard time with as well."

Newsom's comments reflect a balancing act between addressing the concerns of fairness in sports and showing compassion towards vulnerable communities. He pondered, "How can we address this issue with the kind of decency that I think, you know, its inherent in you, but not always expressed on the issue, at the same time deal with the issue?"
