In a recent development, Texas Attorney General Ken Paxton has approached a federal judge, seeking a determination on whether the Biden administration is infringing on a permanent injunction by auctioning unused components of the border wall.
Paxton, a fervent supporter of former President Trump, is the latest figure in the Make America Great Again (MAGA) movement to criticize President Joe Biden following reports of the administration's sale of unused sections of the U.S.-Mexico border wall.
According to Raw Story, Paxton seems to be the first to escalate his grievances to the judicial level, filing a motion to enforce a permanent injunction. The Biden Administration cannot auction off sections of the border wall, Paxton stated on Tuesday. He further claimed, If these reports are true, the Biden Administration is violating a federal court order.
Paxton's request to U.S. District Judge Drew Tipton is for an initial status conference at the court's earliest possible time. This is to ascertain whether the administration's border wall auction is in contempt of its final judgment and permanent injunction.
Paxton elaborated in the legal motion filed in the Southern District of Texas on Tuesday, "As a first step, a status conference is necessary so that defendants can explain to the court and plaintiffs why taxpayer monies, and the congressional appropriation adjudicated by the court for specific purposes, are apparently being squandered for purposes unauthorized by Congress and in violation of the Courts permanent injunction."
In May, Paxton achieved a significant victory that mandated the federal government to continue the construction of the border wall using funds already designated for that purpose. This victory underscores the conservative viewpoint of maintaining strict border control and upholding the rule of law.
Paxton further stated, Texas is going to court to prevent any border security materials from being unlawfully sold and to find out the truth about what the federal government may be doing to subvert border wall construction. He emphasized his commitment to uphold the mandate given to Trump by the American people to construct the wall, vowing to do everything within his power to thwart any acts of sabotage by the outgoing administration. This ongoing saga underscores the tension between conservative and liberal perspectives on border security and immigration policy.
